These Terms and Conditions (“Terms”) govern your access to and use of the Silent Light™ website and the purchase and use of Silent Light™ products. By accessing this website or purchasing our products, you agree to be bound by these Terms. If you do not agree, do not use this website or purchase the product.

2. Product Classification & Intended Use

Silent Light™ is a non-invasive wearable device that uses low-level light (photobiomodulation) to support upper airway comfort during sleep. The device is intended for general wellness support only.

Where applicable under local law, Silent Light™ may be classified as a Class I medical device. Regulatory classification varies by jurisdiction. The device is not registered as a therapeutic device for the treatment of any condition in Australia, the United States, or any other market unless expressly stated in writing by GBLbiotech Pty Ltd with reference to the relevant regulatory approval number.

The product is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition, including but not limited to sleep apnea, obstructive sleep apnea (OSA), or any respiratory disorder.

If you suspect you have sleep apnea or any other medical condition, you must consult a qualified healthcare professional before using this product.

3. Medical Disclaimer

Information provided on this website is for general informational and educational purposes only. It does not constitute medical advice.

No statements on this website have been evaluated by the Therapeutic Goods Administration (TGA), the U.S. Food and Drug Administration (FDA), or any equivalent regulatory authority, unless a specific written statement to that effect is made and accompanied by the relevant registration or approval number.

Use of Silent Light™ is at your own discretion and risk.

4. Eligibility

You must be at least 18 years old to purchase this product. By placing an order, you confirm that:

You are 18 years of age or older;
You are legally capable of entering into binding contracts in your jurisdiction; and
All information you provide is accurate and complete.

5. Orders & Acceptance

All orders are subject to acceptance and availability. We reserve the right to:

Refuse or cancel any order;
Limit quantities;
Correct pricing errors; and
Cancel orders suspected of fraud or misrepresentation.

An order confirmation email is an acknowledgment of your order only and does not constitute acceptance. A binding contract is formed upon dispatch of the product to the delivery address specified in your order.

6. Pricing & Currency

All prices are listed in Australian Dollars (AUD) unless otherwise stated. We reserve the right to modify pricing at any time without prior notice. Import duties, taxes, and customs fees applicable to international orders are solely the responsibility of the purchaser.

7. Shipping & Delivery & Returns

Delivery times are estimates only. GBLbiotech Pty Ltd is not liable for delays caused by:

Customs clearance;
Postal disruptions;
Force majeure events (as defined in clause 18); or
Third-party carriers.
Returns of “Free Trial” sample goods. Goods will be returned following the 2 week Free Trial period Campaign.

Risk of loss passes to the purchaser upon dispatch of the product to the carrier. This does not affect your statutory rights under the Australian Consumer Law.

8. 30-Day Satisfaction Guarantee

If you are not satisfied with your purchase, you may return the product within 30 days of receipt, subject to the following conditions:

The product must be returned in good condition (as defined in clause 18);
The customer is responsible for the cost of return shipping;
Consumables (as defined in clause 18) are non-refundable once the packaging has been opened; and
The refund applies to the product purchase price only — original shipping costs are non-refundable.

We reserve the right to inspect returned items prior to issuing a refund. Refunds will be processed within 14 business days of our receipt and inspection of the returned product. This guarantee does not limit your rights under the Australian Consumer Law.

9. Statutory Rights (Australian Consumer Law)

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

10. Limited Manufacturer’s Warranty

In addition to your statutory rights, Silent Light™ carries a 1-year limited manufacturer’s warranty covering defects in materials and workmanship under normal use from the date of original purchase.

This warranty does not cover damage or failure caused by:

Misuse or use contrary to the instructions provided;
Exposure to water or liquids;
Physical damage (including drops or crushing);
Unauthorised modifications or tampering;
Use of non-approved charging cables or accessories (see clause 11 and clause 18 for definitions); or
Improper storage or charging practices.

To make a warranty claim, please contact us at admin@gblbiotech.com with your proof of purchase (order number or receipt) and a description of the defect. We will acknowledge your claim within 10 business days and advise you of the available remedy (repair, replacement, or refund) in accordance with the Australian Consumer Law.

11. Proper Use, Approved Accessories & Safety

By using Silent Light™ you agree to:

Read and follow all instructions provided in the user manual;
Use only the charging cable supplied with the product or accessories expressly listed as approved by GBLbiotech Pty Ltd at www.gblbiotech.com/accessories;
Not modify, disassemble, or tamper with the device;
Not use the device on broken, irritated, or damaged skin; and
Discontinue use immediately if skin irritation, discomfort, or any adverse effect occurs, and seek medical advice.

The device is not suitable for use by:

Children under the age of 18;
Individuals with implanted electronic devices (such as pacemakers or cochlear implants) unless use has been expressly approved by their treating physician; or
Individuals with a diagnosed sleep disorder, including OSA, unless under the direct supervision of a qualified medical professional.

12. Limitation of Liability

To the fullest extent permitted by applicable law, GBLbiotech Pty Ltd shall not be liable for indirect, incidental, or consequential damages arising from use of the product or this website, including but not limited to loss of income or loss of data.

Our total aggregate liability to you for any claim shall not exceed the purchase price paid by you for the relevant product.

Nothing in these Terms excludes, restricts, or modifies:

Any guarantee, condition, or warranty implied by the Australian Consumer Law that cannot lawfully be excluded;
Liability for death or personal injury caused by our negligence;
Liability for fraud or fraudulent misrepresentation; or
Any other liability that cannot be limited or excluded under applicable law.

13. Intellectual Property

All content associated with Silent Light™ and GBLbiotech Pty Ltd — including but not limited to branding, logos, website design, product design, device configuration, packaging, software, images, and technical documentation — is the intellectual property of GBLbiotech Pty Ltd and is protected by Australian and international intellectual property law. Unauthorised reproduction, distribution, or use is strictly prohibited.

14. Privacy

Your use of this website is governed by our Privacy Policy, available at www.gblbiotech.com/privacy. We comply with the Australian Privacy Act 1988 (Cth), including the Notifiable Data Breaches (NDB) scheme, and with the General Data Protection Regulation (GDPR) where applicable to our customers in the European Economic Area.

In the event of an eligible data breach, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law. We retain your personal data only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law. Where personal data is transferred outside Australia, we will ensure adequate protections are in place in accordance with applicable privacy legislation.

15. Complaints Procedure

If you have a complaint about our products, services, or these Terms, please contact us in the first instance at admin@gblbiotech.com. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days. We encourage you to attempt to resolve any dispute with us directly before commencing legal proceedings.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles. Subject to clause 15 (Complaints Procedure), and without limiting any rights you may have under the Australian Consumer Law, any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

17. Amendments

We reserve the right to update these Terms at any time. Where changes are material, we will notify registered users by email at least 30 days prior to the changes taking effect. For non-material changes, a notice will be posted on our website. Continued use of the website or the product after the effective date of any revised Terms constitutes your acceptance of those Terms.

18. Definitions

In these Terms, the following definitions apply:

Approved accessories means accessories expressly listed as approved by GBLbiotech Pty Ltd at www.gblbiotech.com/accessories or supplied by us with the product.
Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Consumables means single-use items supplied with or for use with Silent Light™, including adhesive patches and nasal strips, as identified on our website.
Force majeure means any event beyond GBLbiotech Pty Ltd’s reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government action, industrial action, or failure of third-party infrastructure.
Good condition means unused, undamaged, and in the original packaging with all accessories and documentation included.

RETURNS & REFUND POLICY

Silent Light™ – Returns, Exchanges & Warranty Claims

Effective Date: 01/ Jan/ 2026

1. 30-Day Satisfaction Guarantee

We offer a 30-day satisfaction guarantee from the date of delivery.

If you are not satisfied with your purchase, you may request a return within 30 days.

To be eligible:

You must provide proof of purchase.
The device must be returned in reasonable condition.
The serial number must match the original sale.
All accessories must be included (charging cable, band, pouch if applicable).

Refunds apply to the purchase price of the device only.

Shipping fees are non-refundable.

2. Non-Returnable Items

For hygiene and safety reasons, the following items are non-returnable once opened:

Adhesives
Consumables
Gift wrapping
Promotional items

Opened consumables cannot be resold and are excluded from refunds.

3. Return Process

To initiate a return:

Contact Customer Support at info@gblbiotech.com
Include order number and reason for return
Wait for return authorization before shipping

Unauthorized returns may not be accepted.

Customers are responsible for return shipping costs unless the item is defective.

We recommend using tracked shipping. We are not responsible for items lost in transit.

4. Inspection & Approval

All returned products will be inspected upon receipt.

Refunds may be refused if:

The device is damaged due to misuse
There are signs of tampering or modification
The device has been submerged in water
The serial number has been removed

Approved refunds will be processed within 7–14 business days.

5. Defective or Damaged Products

If your product arrives defective or damaged:

Notify us within 7 days of delivery.
Provide photographs and description.

We may:

Replace the device
Repair the device
Issue a refund

At our sole discretion.

6. Warranty Claims (1-Year Limited Warranty)

The Silent Light™ device includes a 12-year limited warranty covering manufacturing defects under normal use.

The warranty does not cover:

Accidental damage
Cosmetic wear
Misuse
Use of non-approved charging accessories
Unauthorized repairs
Exposure to liquids

Warranty claims require proof of purchase.

We reserve the right to repair or replace at our discretion.

7. Chargebacks & Fraud Prevention

Initiating a chargeback without contacting us first may result in:

Suspension of warranty
Blacklisting of customer account
Submission of documentation to payment processors

We reserve the right to dispute fraudulent chargebacks.

8. International Orders

Customers are responsible for:

Import duties
Postage
Customs fees
VAT
Local taxes

Failure to pay customs duties resulting in return-to-sender may incur restocking and shipping fees.

9. Consumer Law

Nothing in this policy excludes or limits rights under Australian Consumer Law or other applicable consumer protection legislation.

Where required by law, statutory rights prevail.

10. Device Returns Following the Free Trial Testing Period

If you have received a Silent Light™ device as part of a free trial testing programme, the following conditions apply at the conclusion of the trial period.

The device must be returned to GBLbiotech Pty Ltd within 14 days of the trial period end date, unless you have been notified in writing that you may retain the device.

Devices returned following a free trial must be:

• Returned in the original or equivalent protective packaging.

• Free from damage beyond reasonable trial use.

• Accompanied by all included accessories (charging cable, band, pouch if applicable).

Return shipping costs for free trial devices are the responsibility of the trial participant unless otherwise agreed in writing. We recommend using tracked postage. GBLbiotech Pty Ltd is not liable for devices lost or damaged in transit.

Failure to return the device within the specified timeframe may result in an invoice being issued for the full retail price of the device.

To arrange a free trial return, contact us at info@gblbiotech.com with your trial reference number and we will provide a return authorisation and shipping instructions.
